General Terms of Sale

Article 1 - PURPOSE: This contract is intended for the exclusive use of booking stays in guest rooms at LA PRADASSE, 39 chemin de TOULOUSE, 31450 AYGUESVIVES. Acceptance and compliance with these terms of sale are acquired upon payment of the deposit.

The best welcome will be reserved for guests. The owner of La Pradasse guest house undertakes to personally ensure their welcome with all the desirable attention to facilitate their stay and knowledge of the region.

Article 2 - DURATION OF STAY : The client signatory to this contract concluded for a fixed period may not under any circumstances claim any right to remain on the premises.

Article 3 - RATES : The prices indicated on this site are prices in euros per room per night, for the number of people and for the chosen dates. Our prices are inclusive of all taxes. Breakfast is included in the price. The tourist tax will be indicated as a supplement when billing the balance. Rates and offers are subject to availability at the time of booking and may not be renewed for subsequent bookings. Non-contractual conditions, rates and offers are subject to change without notice.

Article 4 - CONTRACT CONCLUSION : The reservation becomes effective once the client has sent the owner a deposit of 30% of the total amount of the stay price with a minimum of one night per room reserved and at the latest within 7 days from the booking request date. The reservation is recorded and confirmed upon receipt of the deposit.

Payment of the deposit implies acceptance of these general terms of sale.

Article 5 - NO RIGHT OF WITHDRAWAL : For reservations made by mail, telephone or internet, the tenant does not benefit from the right of withdrawal, in accordance with article L121-21-8 of the consumer code relating in particular to accommodation service provisions provided on a specific date or according to a determined periodicity.

Article 6 - CANCELLATION BY THE CLIENT : Any cancellation must be notified by letter or email addressed to the owner.

a) Cancellation before the start of the stay: if the cancellation occurs MORE than 24 hours before the start of the stay, the deposit remains acquired by the owner.

If the cancellation occurs LESS than 24 hours before the start of the stay, the deposit remains acquired by the owner who will also request payment of the balance of the stay price.

b) If the client does not show up before 7 PM on the scheduled day of the start of the stay, this contract becomes null and the owner may dispose of their guest rooms. The deposit remains acquired by the owner who reserves the right to claim the balance of the stay price.

c) In case of shortened stay, the price corresponding to the initial stay remains fully acquired by the owner.

Article 7 - CANCELLATION BY THE OWNER : When the owner cancels the stay before its start, they must inform the client by email.

The client, without prejudice to recourse for compensation for any damages suffered, will be immediately refunded the amounts paid. NB: No cancellation insurance is included in our rates.

Article 8 - ARRIVAL : The client must present themselves on the day specified during their reservation, between 5 PM and 8 PM. In case of late or delayed arrival, the client must notify the owner.

Article 9 - DEPARTURE : On the day of departure, the client must vacate the room before 10:30 AM. Any later departure will result in billing for an additional night.

Article 10 - BALANCE PAYMENT : The balance is to be paid upon arrival at the owner's property.

Consumption and additional services not mentioned in this contract will be paid at the end of the stay to the owner.

Article 11 - TOURIST TAX : The tourist tax is a local tax that the client must pay to the owner who then remits it to the Public Treasury.

Article 12 - USE OF PREMISES : The client certifies being covered by civil liability insurance covering their responsibility and that of their family.

Children of clients staying in the establishment and its surroundings will be under the sole responsibility of their parents. Use of the swimming pool is at the client's own risk. The client undertakes to return the guest rooms in perfect condition at the end of the stay, to declare and financially assume any damage for which they might be responsible. La Pradasse Guest House declines all responsibility in case of theft, loss, damage to personal effects and/or damage or injury to property or persons on the property, regardless of the cause.

In case of items forgotten in the room at the end of the stay, the items can be sent to the person concerned, upon their request and at their expense. The client must respect the peaceful character of the premises and use them in accordance with their intended purpose.

Article 13 - CAPACITY : This contract is established for a specific number of people. If the number of clients exceeds this number, the owner is able to refuse additional clients.

This refusal cannot under any circumstances be considered as a modification or breach of contract initiated by the owner, so that in case of departure of a number of clients greater than those refused, no refund can be considered.

Article 14 - BREAKFAST : Breakfast is served each morning in a location that will be indicated to you the evening before (garden, dining room...). It is served between 8 AM and 10 AM.

Article 15 - ANIMALS : Pets are not allowed. In case of non-compliance with this clause by the client, the refusal to accept animals and their owners by La Pradasse Guest House cannot be considered as a modification or breach of contract initiated by the owner, so that in case of the client's departure, no refund can be considered.

Article 16 - RESPECT OF PREMISES : Respect for a certain "art of living" is requested from all clients to guarantee the tranquility of the place and the comfort of all. The client undertakes to respect the guidelines for good living appearing in these general terms of sale.

Furthermore, please refrain from smoking in the rooms or at windows and from lighting candles. All rooms of the guest house (bedroom, living room, dining room, etc.) are strictly non-smoking.

Private areas are not left at the free disposal of clients.

It is forbidden to eat in the rooms. The dining room and pool areas cannot be picnic areas.

Any disrespectful attitude towards other clients and/or facilities may result in immediate cancellation of the reservation.

Only people staying at La Pradasse Guest House are authorized to use the common areas and the swimming pool.

Please do not throw anything in the toilets. Please also do not use towels for makeup removal or shoe cleaning. We reserve the right to charge the replacement cost of towels and/or linens stained by these products.

Article 17 - SWIMMING POOL : The swimming pool is open from May to September, from 9 AM to 6 PM. The pool is reserved exclusively for family members and close friends of the owners, and for clients staying in guest rooms. La Pradasse Guest House reminds clients of the absence of pool supervision. Any swimming in the pool must be done under the constant supervision of adults capable of intervening quickly in case of danger. Access to the pool and its surroundings is forbidden to unaccompanied children: children must be under the active and vigilant supervision and sole responsibility of their parents. Any pool user must be covered by civil liability insurance with defense and recourse coverage.

The property owners disclaim all responsibility in case of accident or drowning.

Article 18 - DISPUTES : Any complaint relating to the condition of the premises must be submitted to the departmental or inter-departmental branch of Gîtes de France within three days following the start date of the stay.

Any other complaint relating to a stay must be addressed by letter, as soon as possible, to the departmental branch of Gîtes de France, competent to issue a proposal in favor of an amicable agreement.

These provisions do not prejudge any legal action initiated by the client or the owner. In case of dispute, French law applies. The High Court of Toulouse has jurisdiction in case of dispute not resolved amicably.

Article 19 - DATA PROTECTION: In accordance with the law of January 6, 1978, law no. 78-17, you benefit from a right of access and rectification to data concerning you. La Pradasse Guest House undertakes not to transmit the information communicated to other companies or organizations, except to competent authorities.
